Accession To The Wto After China's Administrative Discretion To Exercise Its Legal Control

The power of free admininstrative is very necessary to modern aministration , the execise of it is one of the most difficult problems in the administration process in accordance with law,in order to realize the strategic target of administering the country with law, the strength of its control is needed, This article expounds the concept of the power of administrative freedom,its existent basis of theory and reality,lays systematic emphasis on the accordance of the control over administrative discretion, in the meantime,it analyzes the real legislative condition of adwinis-trative discretion, and analyzes the control theory of administrative discretion in American,in accordance with request of the exercise of administrative discretion after joining the WTO, It is stressed at the end of the article that the comprehensive and effective supervision and control of the administrative discretion by many means is possible. These major measures of control are: Improve legislative system and improve on legislative quality; Normalize procedure of administrative discretion and increase its openness; Improve the system of judicial control and increase the strength of it; Strengthen the control of administration itself. In these measures,the control of procedure is especially emphasized.
