The domestic and international scholars have already published many articles with this research,, Two problems are existing in this research,, Firstly, the study from historiography angle is sufficient while that from legal angle is insufficient; Secondly, the research on the operating of the Monopolizing system is much less than that from macroscopic angle. The aim of this article is to expose that looser Monopolizing tea law is apt to the sprouting of capitalism, While the Monopolizing tea law in Song Dynasty prevented the producing of the sprouting of capitalism on the whole, and to solve the above problems, gaining some benefits from the study of legal history at the same time.The article is divided into four parts . On the basis of investigating the history of ancient ChineseMonopolizing tea law, especially discussing the Monopolizing tea law of Sichuan Province in Song Dynasty in order to expose the sprouting of capitalism in tea industry realm.The historial outline of the Monopolizing tea law is illustrated in the first part, I analyze the meaning of the the "monopolizing law" , the Monopolizing tea law in Tang, Yuan, Ming and Qing Dynasty with many severe law measures enacted.The aim of the Song government enacted the Monopolizing law is analyzed in the second part in which I have the opinion that the aim of the feudalistic society before Song enacted the Monopolizing law is to limit the excessive development of the businessman and merchant capital, and to accumulate the public finance income in Song Dynasty, While the aim of the Song government enacted the Monopolizing tea law in Sichuan is primarily for the sake of the military.In the third part, I analyz the Monopolizing tea law of Sichuan Province in Song Dynasty, in which I put great emphasis on discussing the horse and tea law, for it has the function of national defence.At the same time the Song government enacted many severe law measures about tea producing, transporting , taxing, forbidding and so on in order to make the Monopolizing tea law effective.In the forth part, I discuss the sprouting of capitalism in tea industry realm of Sichuan province where has some factors that are good to the sprouting of capitalism. Finally it is exposed that looser Monopolizing tea law is apt to the sprouting of capitalism ,While the Monopolizing tea law in Song Dynasty prevented the producing of the sprouting of capitalism on the whole.
