Some Problems On The Crime Of Accepting Bribes

It is a very difficult and important issue in the science of criminal law to handle the offence of bribery theoretically and practically, There fore, it is urgent to study further in this field in order to perfect our legal system along with the prompt development of China's market economy and her entry to WTO.On the base of research and comparation of offence of bribery in different countries and according to China's current criminal law legislation, this article focuses on the constitution, distinction and limitation of offence of bribery and also put forward some valuable advice on perfection of China's criminal law legislation. It mainly includes as follows: The natural person subject of offence of bribery should be stipulated as not only persons who deal with public affairs but also as managers of business; and undeserved benefit should be added to the content of bribe; and capacity penalty also should become a mew part of criminal punishment system of China.
