On The Crime Of Contract Fraud

To the disputes of some problems on the Contract Fraud in the academic circles and in the judicial practice, the thesis further explains the contract fraud, covering the crime concept, crime formations and crime and non-crime point of view. First of all, the thesis rationally defines the concept of contract fraud, then analyzes the characteristics of the subjective aspects of this crime from the direction of crime formation, especially puts forward my own opinion on the "unlawful possession as the purpose" and studies the objective aspects of contract fraud and confirmation of contract fraud in unit. Then the thesis mainly deals with the crime and non-crime of the contract fraud and clearly points out the difference between contract fraud and contract breaching dispute and that between contract fraud and crime of embezzlement. Finally, declares my view on the amount of contract fraud in applying this crime penalty. All this above is expect to give the legislative theory and judicial practice some help.
