On The Value Of Civil Procedure

The center of civil judicial reformation is to reappraise the value of civil litigation procedure. This paper discusses the internal value of civil litigation procedure-justice , stabilization and efficiency ; the external value of civil litigation procedure-insuring justice of entity , protecting civil right and setting the pace of judiciary authority ; and when the conflict was caused between the internal value and external value , how to solve it. According to the comparison between procedure justice and entity justice , the writer believes that procedure justice should be laid first place . Not only is procedure justice inside the law , but also is widespread . This is the essence that judiciary justice requires . The last part is about protecting measures of the value of civil litigation procedure . In the first place , we should prevent deviation of the value of procedure ; in the second place , justice would be brought into effect by law . The civil judicial law which is executing in current should be strengthened in openness of judge , neutrality of gownsman , adjudgement without plaintiff or appellee , and so on .
