Embezzlement Of Public Funds A Number Of Issues To Study

The new century falls, with the continual carrying out of reform and opening up policy, the socialism market economy has developed very fast. Crimes relating to embezzlement particularly misappropriation of public funds severely destroy the social economic order, which constitutes the great threat towards the establishment and perfection of the socialism market economy. The article takes misappropriation of public funds as the research subject, with it's concept and constituents analyzed historically, comparatively and also on the basis of law. I set forth my position on the different understandings of crime constituents of embezzlement arising from the theoretical and judicial circles, focusing on the analysis of countermeasure practical, not on pure theory, combing the judicial practice, and making a preliminary research into bettering the legislation of embezzlement and applying the embezzlement in judicial practice.The article is divided into four parts.In the first part, the history of embezzlement is explored.In the second part, the object of embezzlement and criminal targets are expounded. Given that a heated argument lie in the object embezzlement infringes upon in the present theoreticaland law. I offer my view on these arguments.In the third part, the subjects of embezzlement are elaborated, with officers, quasi-officers and those who perform official duties in accordance with law defined and accomplices of embezzlement analyzed in theory.In the fourth part, the objective aspects of embezzlement are detailed analyzed. Whoever has public funds to oneself, fails to return beyond the limit of three months, takes up illegal management, fails to return the large sum of public funds embezzled, and carries public funds to abscond are sentenced to corruption.In this article I delve into the understanding and definition of such social phenomenon.
