Immigration is a natural phenomenon in the ancient time. It has became the social phenomena and restrained by the law since the states appeared. Chinese entry & exit legal system occupy the important position in the international immigration legal system because of the development of world history and Chinese national conditions. The author thinks that the reform and readjustment is very necessary for Chinese entry & exit legal system under the new circumstance. Scholars and government officials have made quite helpful discussions about this. But the discussions field is limited by the history and objective reality. As a stuff member of entry & exit administrative organ, the author tries to analyze the above question and makes suggestions by his own practice. After the author reviews the development history of the New China entry & exit legal system, he contrasts the major contents, legal basis and organizational setup, immigration legal type and division of duties of Chinese entry & exit control with other countries in detail. In the next part he mainly analyses the problems, reform and readjustment in the Chinese entry & exit control. In order to solve the problems in the entry & exit administrative legislation, the author proposes 6 adjustment principles. To solve other problems such as entry & exit administrative management system is outdated, organizational setup and division of duties is unsuitable, the administrative organs are not administer by the law strictly, the author suggests that the Chinese government should create new entry & exit administrative management system, reform administrative examination and approval system, strengthen the supervision on administrative examination and approval right. The passport - issuing reform is the focus in China. The author thinks that "Passport - issuing Depend on Citizens Demands" policy is a historic significant event. In practicing this policy, entry & exit control administrations should pay more attention to the basis work and the follow- up work.
