Illegal Exclusionary Rule In Criminal Proceedings

This article explores the problems concerning the rules of excluding illegal evidence. The whole thesis contains about thirty thousand words.Part one: brief introduction of illegal evidence. This part analyzes the concept of illegal evidence, and then points out the characteristics and types of it.Part two: the comparative analysis, background and notion of legislative models in the two big families of law. This part points out the traits involved in rules of excluding illegal evidence in the two families of law, the development and changes as well the background and notion of them through the comparison and analysis of legislative models of rules of excluding illegal evidence in the tow families of law.Part three: the present conditions of applying the rules of excluding illegal evidence in our country. The part puts forward the law foundations of legislating these rules, the main disputable ideas regarding these rules at present; gives the cardinal point of making rules of excluding illegal evidence on the basis above and the difficulties when making these rules in China.Part four: tentative ideas of establishing rules of excluding illegal evidence. The part raises the concrete tentative ideas of applying these rules in our ideas country in addition to the operating procedure to realize these and specific corresponding measures.
