Water rights transaction is a newly emerging thing in our country. This thesis employing studies water rights transaction, economic methods of law and institution and analyses the influence of institution upon water resource allocation. It combines modern property rights theory, transaction cost theory and game theory and bases on the research method of property rights theory in new institution economics.This thesis is composed of six parts:Part I briefly reviews the main point of scholars home and abroad on water institution and water right transfer.Part II focuses on the background of Chinese water right transaction. The water resource of Chinese is under constant stress, with the distribution of North and East lack of water while south and west abundant. Under the traditional common water resource conditions policy, institutions and market leads to the distortion of water resource allocation.Part III deals with the institutional presupposition of water rights transaction. From water right institution and the experience of water rights transaction in foreign countries, water rights transaction is the product of applying market method on water resource allocation, the institutional presupposition being clear clarification of water right.Part IV devises a basic framework of water rights transaction. Divides water rights market into first second market and employs the game theory to illustrate the best water resources allocation through water right transfer.Part V focuses on external effect of water right transaction, the influence of water transaction on environmental and agricultural use water. When the water rights transactions causes the change of time and special distribution of water resource.Part VI points out the advantage and disadvantage of Chinese water right transaction institutions.
