On The Real Rights For Security

With the development of China's social market economy, it is a pressing task to formulate a complete law about thing's possession. While the defination of the kinds and contents of thing's possession is the foremost important task of its legislation. Real Right for Security is an important part of possession law system. Therefore we need to add and complete the contents and regulations of possession security based on the present condition if we want to perfect the system of possession law. This article including two parts discusses the theory of possession security. The first part is the introduction of possession security, which includes the historical development, function, meaning, classification and responsibility of the possession security. The second part focuses on three typical kinds of possession security-pledge, mortgage, and lien. This part introduces the theoretical background and probes into the arguable problems in present laws. The writer hopes to construct the perfect system of possession security from practical point of view and provides some theoretical references for the establishing of possession security.
