Study Of Commercial Bank Bankruptcy Law

The law of modern bank insolvency is aimed to prevent bank insolvency. It plays an important role in preventing bank insolvency from happening and reducing the loss of banks to the minimum level when the bank insolvency is inevitable and protecting the interest of depositors. The law of modern bank insolvency is one of the most important factors in the legal system of modern commercial banks. With the advancement of China's financial reform and as the date of opening up our financial field as promised is drawing near, some scholars in China have paid more attention to this field. This thesis covers some of the legal issues concerning the insolvency of commercial banks as follows: First, after a study of the basic issues of the law of corporate insolvency and the law of bank insolvency, the differences and relevance of these two laws are examined. Second, this article studies different implementation modes of the bank insolvency law in certain counties and areas and the role of the managing institutions for bank insolvency in the proceeding of bank insolvency.Furthermore, different measures adopted in the proceeding of bank insolvency are examined from different perspectives.At last, based on the examination of the current situation of China's commercial banks and their insolvency, some deficiencies in our bank insolvency law are pointed out. Some legislative suggestions are offered on the basis of China's current situation and the legislation and its implementation of relevant laws in other countries.
