Problems And Countermeasures Of China Trust Industry Research

With the "Law of Trust" issued and implemented in 2001, the "Administration Methods of Trust and Investment Corporation" and "Temporary Administration Method on Fund Gathered from Trust and Investment Corporation" in 2002, as well as completion of re-registration of those kept trust and investment corporations, the trust industry in China has presented a brand-new systematic environment. Under this new circumstance, the trust industry in China has got a specific direction in functional orientation and business development in the financial system, the trust industry has carried out business innovation by following the requirement of economic development, and it has got certain conditions in system arrangement, financial tools selection, external needs and internal dynamics. Furthermore, given the strict business division in our financial field, the big span and wide scope of trust became an obvious advantage comparing with banks, fund management corporations and stock companies. Relying on these strengths, our trust company now is facing huge development opportunities in the new systematic environment. However, there are still some urgent problems to be solved in the trust industry in China, such as shrinkage and clearance traditional business, exploration of funding sources and fund handling channels, remolding of credit, law faultiness and single business variety and so on. Solving those problems will ensure the stable and continuous development of the trust industry.This article analyses the existing problems in the trust industry based on the real status of the trust industry, especially the existing problems after consolidation. By referring to experiences accumulated in foreign trust industry and combining it with the facts of the trust industry in China, it proposes some countermeasures from the aspects such as speeding up construction of law system, strengthening supervision of trust industry, perfecting risk management system of trust industry and developing trust businesses and so on. Moreover, it stresses that the trust industry in China should take its own business development as the base of development.
