Safeguards Applicable Research

In this issue, the safeguard measures mainly refers to "Agreement on Safeguards" of WTO and "Article XIX of GATT 1994". Although the agreement has clarified the disciplines of the article XIX, there are still some disputations on the applicable conditions. For those reasons, the writer used the way of analysis though cases, firstly analyzed all the applicable conditions. Secondly, though researching some problems of the applications of the agreement, made some conclusions as following, the regional economic collectivization should not be the exception of "non-discrimination" principle, allocation of a quota among supply countries can keep the elasticity of the principle. To protect the benefits of the developing country members, there should be a criterion to definite the developing country members on some economic data of the members. The writer also point out when there is a conflict between the agreement and domestic legislations, the agreement should be prior, but this may depend on the improvement of the Agreement. Finally, the issue provides some counterraeasures on the "Transitional Product-Specific Safeguard Mechanism" .
