China's Securities Regulatory Legal Issues

China securities market has experienced world-famous and great development in the past more than ten years. Whereas, the securities market of our country is in the entry-level stage of the development still, at present there are various kinds of illegal phenomena in securities market, which reflect different kinds of problems of China's securities regulation. Through research into some legal problems concerning securities regulation applications, this thesis generalizes the basic theories and the law relation of securities regulation, and makes a comparative analysis of overseas advanced experience. It explores in-depth of China's securities regulation system in progress as well as its existing problems, and then accordingly gives some suggestions for the healthy development of China's securities business. This thesis is composed of four parts.Parts One, gives a general description about securities regulation, including the definition, the aims, the principles, the method and the law relation, the law result of it. This chapter can serve as the theoretical basis for further detailed research. Parts Two, makes a comparative study of three different securities regulation patterns such as the type of government domination in the United States, the type of self-regulation domination in United Kingdom and the type of intermediate in France, focusing on their respective characteristics in terms of supervision, thus concludes some positive experiences which can contribute to China's securities regulation system.Parts Three, on the basis of practical status of China securities regulation, makes an analysis on the process of formation, the modality and the obvious characteristic of China securities regulation system, especially on the typical problems in the law of securities regulation.Parts Four, is the emphasis of this thesis. On the base of analyzing existent defects in China and learning from overseas useful experiences, this chapter puts forwards perfected advices about the polestar of securities regulation, the authorities and the restriction of the supervision organization, the self-discipline supervision, the listed' company supervision and so on. It is necessary to improve China securities regulation system so as to ensure the stable development of the securities market.
