| China is being integrated in global economy. Especially when China entered into WTO, she is confronted with the opportunities and challenges at the same time. The FDI, the important form of international capital flow, play a vital role in every country day by day. The present situation of FDI turn to be a kind of standard judge a country's economic strength and international competitive capacity. Our country have recognized the one-sideness of absorbing foreign capital only, began to employ the foreign capital though FDI. Faced with the situation, Chinese enterprises have to go abroad, invest in foreign countries, promote transnational management, open up outside regions for living and development, and this is the only way for China to merge into the trend of globalized integrated economy. Since China took the policy of open-door and reform, China's overseas direct investments are growing rapidly. China has already become one of the largest developing countries with a large amount of investments abroad. But as compared with world's main capital-exporting countries, China still has a large gap to catch up. There are all kinds of reasons that work the current situation. Nevertheless, in a sense, it is in the final analysis because our law regulate the FDI are too deficient to meet the requirement of FDI's development.The present essay mainly consists of two parts. The first part firstly analyses the meaning of FDI and modes, secondly introduce the developing stages of China's FDI, thirdly analyses the exigency and possibility of developing China ' FDI both theoretically and practically, finally generalize the characteristic of China' FDI. In the second part, this essay center on the orientation to overseas direct investment law, the analysis of world's main capital-exporting countries' overseas direct investment law and studies on our real national conditions and the author tries to conceive China's overseas investment law. |
