On The Reconstruction Of The Implementing Agencies

Executing institutions should be how-to set, which mostly relies on the quality of civil executing power. Those countries whose law systems have been more developed researched them when they stipulated for Force Executing Law. But they are many differences about quality of civil executing power and how-to setting executing institutions and so forth. They are in reforming phases in our country. The opinions always cannot be unified.This article tries to probe into these two questions from multi-aspects, such as development of the history, remarking to present opinions, law rules of other countries and its rationalities, and comparing with the similar systems. We puts forward that civil executing power is the quasi-administration power, and according to this, we set the executing institutions in the judicatory administration departments. We hope that we can bring forward a route for Chinese civil executing reform, and have an effect on relieving or resolving the question of "unmanageable execution".
