Embezzlement Study

The Crime of Embezzlement, which is a new charge in the currentCriminal Law of our country, infringes upon other's property rights. This essay makes a tentative study on the crime and elaborates from below five aspects.In introduction, a conception of the Crime of Embezzlement is summarized by comparing and analyzing, which can reveal the essential feature of the guilty. The crime of Embezzlement is divided into two kinds: the common crime of Embezzlement and the guilty of embezzling the property that has been forgotten about or buried. It accords to the development of the times that adds the Crime of Embezzlement to the current Criminal Law of our country .The part of the objective aspects of the Crime of Embezzlement: These are interpreted, the meaning of the entrusting someone with the care of his property the foundation of holding , the larger amount the implication and the time boundary of refusing to return others' property or refusing to hand it over.The part of the subject of Crime of Embezzlement: Two questions are narrated, its subject being special and including the units.The part of the subjective aspects of the Crime of Embezzlement: It aims at owning public and private property unlawfully and has the direct intent subjectively.
