Maritime insurance fraud is one of the maritime fraud. It has quite a lot of peculiarity on account of its similarity to the maritime fraud. Because the relation of the insurance is speculation, relating to utmost good faith principle and insurance interest principle. For this reason,the article apply the conventional fraud theory of civil law and contract law,including department law of insurance law and maritime law.According to the peculiarity of insurance law, we will research it basing on the prevention and cure the question of the maritime insurance fraud.The first chapter is te inTroductionTrto the concept of the insurance fraud, including the definition, component, behavior and analyzing the essential of maritime insurance fraud.The seconed chapter is the essential harm theory ,which illustrate the essence of the fraud is violating the utmost good faith principle and insurance interest principle.Every fraud has its corresponding cause including the maritime insurance fraud, this is the content of the third chapter. The fouth chapter illustrates the tort nature of the fraud.Under the rule of insurance law, setting up anti-fraud regulation and measurment, aiming to punishment and prevention the fraud, we will illustrate it in the fifth chapter.
