Punitive Damages System

This paper discusses punitive damages which is important Anglo-American law and gives some advices on how to receive it under Chinese law system. The author also gives a functional analysis of punitive damages ,he insist that the aims of punitive damages is not punish a person who commits a tort ,but compensate the se who have suffered as a result of a tort and discourage the conduct of the type the defendant engaged in and encourage plaintiff in struggling for civil rights . This paper also discusses the necessity of establishing punitive damages in Chinese law system .Especially ,the author tend to contribute some good ideas to the Chinese Code Civil which is being drafted by experts .
