Parties In Civil Litigation Theory Reconstruction

Starting from the fundamental theory on litigant and through the comparison and analysis on fundamental concepts of litigant theory the thesis discussed the concept of litigant in civil litigation. The concept of litigant roughly experienced a course of doctrine of interested party, doctrine of right-protecting litigant and significance of procedure litigant. With the deeper and deeper discussion on the concept of litigation that will be benefit to spread the space to protect right of litigant, widen the possibility and jurisdiction function of protecting civil rights, lift the self-controlling of procedure and go further step to ensure execution of litigation rights. By expounding the concept, capability and qualification of litigant, the thesis more reassured the definition of the concept of litigant and fully respected the rights of litigant that is the inevitable outcome and requirement of the development on litigation democracy.
