Real estate management is arising as a brand-new enterprise in our country in recent years, which is so called a morning-sun enterprise in modern cities. Where there is demand there is market .In the real estate management market, owners who own the real estate are demanders of real estate management, while the real estate management companies are the suppliers. Both the owners and the companies accomplish the whole real estate management, realizing keeping and improving the value of the real property. In the same time, it provides a safe sanitary, silent and harmonious environment for working and living to owners, combining economic, social and pathetic efficiency into one. Only we understand the legal position, rights and obligations of both the owners and companies can we understand the whole system of real estate management.Because the real estate management develops rapidly ,it results in the legislation related lag. Obviously it is very important to confine the legal rights and obligations of the both and limit the actions of the both by a contract. The owners who demand the real estate management service have the ownership of real estate, from which the management rights originate. The owners confer the right of management to a special real estate management companies by signing a contract which designating the rights and obligations of both, so the whole real estate management goes well. This paper begins from the subjects of real estate management to analyze the mechanism of real property management.This paper falls into four parts. The third part, legislation review on the subjects of real property management in foreign countries .The last part, existing problems on the subjects of real estate management contract in our country and how to solve them.
