On November 12th, 2001, our country entered into WTO in the capacity of the developing country, which marks the formation of the outer mechanism for implementing the basic policy of opening to the outside world and creates excellent system conditions for our country's further participation in international division and economic globalization. But in recent years in the world trading appears new tendency: some developed countries have enforced a new trade protectionism by formulating a higher standard of environment quality than that of developing countries, that is to they utilize high environment standard enter condition as means of restricting imports with the result that the traditional trade barrier has developed into the environment barrier, green trade barrier. With developed countries standards increasingly getting strict, the green barrier is becoming a new trade protectionism in the world trade. Some traditional products made in the old mold of production have been restricted or even forbidden, which all makes the export trade of developing countries suffer, a certain degree, impacts and influences. Since the success of Uruguay Round negotiation in 1994 and the establishment of WTO in 1995,tariff barrier in world trade and traditional non-tariff barrier have been dying down. However certain countries pursue "green" trade protectionism pretexting environment protection because of international financial turmoil aggregation s the international economy acceleration rate slows down > fierce export trade competition and uneven global trade aggravation. Recent years, trade dispute caused by environment barrier has became a great characteristic in international trade. Since China just entered WTO , the trade barrier with "decent coat" has caused great negative effect on the development of our country's export enterprises and even on the implementation of strategy of our country's entry to WTO. So, I believe it is necessary that we should know the green trade barrier clearly and objectively, study its contents and characteristics seriously, grasp the rule of its formation and development deeply and propose workable measures in good time.Although WTO has made great progress in formulating the environment rule, there still exist a lot of problems which are as below:WTO emphasizes on the "exception right of environmental protection" relevant to environment trade rules for every member, but lack explicit and effective restraint standard for enforcing the rights. As a result, they are very likely to be abused, especially by trade protectionism, thus bring about a threat for global liberalization of the trade, especially for trade of developing countries.WTO has made differentiated or favorable arrangements for developingcountries. It looks fair that both the developed countries and the developing countries are treated with "one knife cut" with regard to environment protection, but it ignores actual fact that there are differences between South and North. Therefore it will make developing countries face more serious situation.The existing environment rules of WTO which are ambiguous can't prevent the abuse of protectionism effectively, but on contrast they provide an chance for protectionism to be put on reasonable "multi-coat" which brings about the overflow of "green barrier" and constant occurrence of green trade dispute.Firstly, this essay introduces the background in which green barrier appears in the international trade, then it analizes its basic characteristics and multi-faceted influences on the export trade of our country, and then from the angle of markets it analizes and build models to explain enterprises' preference to the standards. Considering the fact and future of our country's enlargement of the opening to the outside world. What this article is focusing on is not the competition of the third-side market but that of domestic market and governments aptitude to the standards.
