Judicial independence is one of the most important characters of modern countries ruled by law,but it is not likely to be realized in a short time as we expect.The realization of judicial independence in England before the 17th century shows that judicial independence is based on the suitable ideological,economic,political,professional foundation.It is a main idea to rule the country by law in ancient Europe, from Greece, Rome to England.Commodity economy is more important the foundation of judicial independence than the idea of power under law Judicial independence is the objective result of the developement of commodity economy.The political structure of separation and mutual restraint of powers and legal profession comes out with the fast developed commodity economy.So judicial independence gets the guarantee of the political and professional foundation.The history of the development of judicial independence in England shows us that,judicial independence also will come out in China,but it is a long way to go.It will come out with the developement of commodity economy,the deepening of the reform of political structure and the developement of the powerful legal profession.
