Agency By Estoppel

"Agency by estoppel" is an important part of agency system institution. The Chinese "Contract Law", coming into force as of October 1, 1999, explicitly sets forth the rules on agency by estoppel institution. However, there are still various views relating to the agency by estoppel in academe, which in judicial practice, to a certain extent, has impact on the application of the institution. Through discussing the concept, components, forms and burden of proof, as well as legal effects of agency by estoppel respectively, this article analyzes the agency by estoppel; and points out what should be concerned in the course of judicial practice and consequentlyputs forward some suggestions on advancing and completing the Chinese legislation institution.
