On The New Charges Established

Standing at the frontier of current criminal law especially of China's and starting from solving the questions of criminal legislation and jurisdiction practice, the thesis discussed and expounded the model of establishing new accusations in criminal law, boldly raised the new model of establishing special accusations which are jurisdiction-into-legislation and legislation-into- jurisdiction. The thesis expounded the significance of establishing new accusations, analyzed and investigated the different form, method and legislation model on establishing new accusations of China and foreign law systems, focused on explaining the role and state of judicial precedent, furthermore it led judicial precedent into written law system. Meanwhile the thesis focused on looking back into the establishing new accusations of the two criminal codes of our country, formed a new and practical and objective model on establishing new accusations through the above analysis. The thesis expounded the criminal theories, criminal principles and criminal criteria that are relative to this model, discussed fundamentally on the relations and counteractions among the abovementioned factors as well.
