Study Of Character Evidence

Character evidence refers to the character of the criminal litigant participants. It includes three parts: previous crimes; the reputation of the participants at the community; and the comments on the participants by people who know them well.In countries practicing British and American laws, there exists a set of corresponding application rule for character evidence, whereas in China there is no corresponding laws. Based on the analysis of the contents of the character evidence, the paper analyzes the effect and meaning of character evidence in each stages of the criminal action and trial of the junior crimes in terms of the practicality of the character evidence, suggesting the operation rules applicable in China to make character evidence better serve judicial practices of China.
