Safeguards Research

Safeguard measures is a kind of protective measure which provides the importing countries the right to remedy their fragile domestic industries and restrict the foreign goods. And WTO agreement on safeguards establishes strict provisions for implementing and procedural conditions to guide the application of member states. As a new member of WTO, to carry out its promise to abide by the rules of WTO and to adapt to the legislative demands, China must continue to perfect the legislative system regarding safeguard measures. So this dissertation introduces WTO safeguards regime from the angle of definition, nature, developments, theoretical basis and comparison with other relevant systems in the first part. Then it elaborates the conditions of implementing WTO safeguard measures and typical domestic laws and regulations of the United States and European Union. It focuses on the analysis of their advantages and disadvantages, so their legislative experiences can give a reference. The last part introduces status quo of safeguards regime in our country and puts forward the suggestions on the legislation our country should take.
