| Trade secret includes technology information, management information and the othe secret information should be protected.As the trade secret, it should be secret, valuable, original and be kept secret by some measures.Protection of trade secret right by law is beneficial not only to the development of innovation results, but also to the competition environments of the market-oriented economy. In our country, Trade Secret law Protection is still a new task to be given for us all. And there are aslo lots of problems to be researched and sovled not only in theory of trade secret protection but also in practice relation to it.This lecture discuss the underlying principles including the definition of trade secret, the range and the necessary conditions of trade secret, trade secret tort, the relieve of tort and so on. In this paper ,a elementary conceive about how to perfect our country's legal system of trade secret protection is drawn by using for reference to foreign advance practices. I hope it would be useful to our trade secret protection legal system and the judicature practices. |
