On The Civil Contract

This article is made up of four parts. The content of the first part is the conspectusof litigation contract, involving the researches into the concept and ultimate charactersof contract as well as expurgation of the concept of litigation contract, as the foundationfor the later treatises. The second part is about the system base and jurisprudence basefor litigation contract. The third part is about the classification of litigation contracts andtheir legal qualities. In this part the application of law on different kinds of litigationcontracts is specified. The last part is the central one, mainly concerning theconstruction of the system of litigation contracts in China. The material ideas are asfollows: establish the standard for application scope of litigation contract, and certifythe various sorts of litigation forms, including ones that have been in the active civilprocedural system of our country, as well as those that should be admitted throughlegislation in the near future on condition that other correlative systems could be rebuilt,and then argue that the content of the litigation contract system should be kept open tothe unceasing changing social circumstances, and lastly expatiate the disadvantages oflitigation contract, and prove the essentialness for setting up some districting measureson litigation contract.
