The Style Of The Legal Language And Its Cultural Interpretation

Law has been receiving attention from anthropologists, psychologists and sociologists. But now linguists also keep an eye on it, and focus on the intersection of law and language. The term, forensic linguistics, began to be used commonly in the 1980s and by now appears to be the established name for this area of study. By the 1990s, forensic linguistics had established its own academic organization, The international Association of Forensic Linguistics, its own journal, TheInternational Journal of Speech, language and the law--ForensicLinguistics, a growing number of books and articles, and an increasing number of experts doing the work.In the field of legal language's style, Chinese scholars share their viewpoints, whose angles and emphases are varied only because of different discipline background. There are few works and papers that study cultural analysis from legal language, and systemic theoretical framework can't be constructed. In fact, the use of legal language in cultural settings exactly reflects the trend of transition from static general research to dynamic applied one, represents the future of forensic linguistics. So I choose the above-mentioned components as the topic and content of my paper, and I believe it is theoretical valuable and creative, at least, a new opinion.Language analysis and Contrastive analysis constitute the article's methodology. The style of legal language is discussed firstly in this paper. In the course of its rapid development, the legal language hasshaped unique style gradually, which is classified into four types: (1) preciseness & norm; (2) strictness & carefulness; (3) succinctness & conciseness; (4) solemnity & plainness. In addition to this, the freshest stuff serves the thesis.The second of the present paper deals with the linguistic research of legal culture and law interpretation. Language is akin to culture. Legal language is no exception. On the basis of a series of arguments which consist of the introduction of Chinese thriving legal culture, the comparative analysis of law interpretation in the world and the approach to law interpretation in our country. The conclusion as follows: (1) In China, the object of study of forensic linguistics is rooted in the legal culture; (2) Humanism is NO. 1; (3) Given that law is a profession of words, it is not surprising that linguists have played increasingly active roles as constants and expert witness in legal arenas over the past couple of decades. However, insightful and intensive researchers are still lacking. In China, the research is just at the initial stage, but can no doubt flourish, which is the accelerator of Chinese law interpretation's progression.
