The　Dian　is　a　bargaining　fashion　of　real　property　in　China.After　the　long-term　development　in　history,　the　habits　of　Dian　have　been　quite　upgrown　and　complex　in　earln　20th　century.　Qing　dynasty　was　forced　to　rectify　the　law　on　condition　of　inside　concern　and　foreign　aggression.The　manner　of　reformation　is　to　reclaim　the　traditional　custom　of　our　country　by　legal　theory　of　western　countries.　　　The　custom　of　Dian　is　among　the　list　of　being　reclaimed.　The　article　is　focused　on　the　period　1900　to　1930,reviewing　the　process　of　the　right　of　Dian　in　eye　of　western　legal　theory　countries　,in　which　the　Dian　in　our　traditional　habits　evolved　step　by　step,and　I　try　to　interpret　the　evoluation.The　purpose　is　to　offer　reference　to　dispose　the　relation　between　the　custom　and　the　law　in　modern　times.　　This　article　consists　of　introduction,text　and　conclusion.The　text　is　four　chapters　in　number.　　　　　The　introduction　briefly　remmend　the　basic　complexion　of　the　Dian　and　status　quo　in　the　Dian　research　at　present,as　well　as　ways　and　means　of　study　in　paper.On　the　foundation,the　introduction　summarizes　the　basic　content　of　the　paper.　　　　　The　chapter　1　of　the　text　mainly　show　the　complexity　of　the　Dian　at　initial　stages　of　20　century　in　three　aspects:　the　unwritten　law　of　the　Dian,the　concept　of　the　Dian　and　the　positive　law　in　the　Dian.and　analyse　the　cause　of　formation　of　the　Dian.　The　chapter　2　points　out　the　misread　of　the　the　Dian　by　the　jurist　in　civil　law　of　Japan　,and　the　absence　of　provision　on　the　Dian　in　The　Code　of　Civil　Law　and　the　distortion　of　the　Dian　in　judgement　which　is　caused　by　the　misread　of　the　Dian.Then　the　second　chater　narrates　the　background　of　the　result.　The　chapter　3　exoatiate　on　the　right　of　the　Dian　instituted　in　practice　by　the　court　during　the　period　of　Zhonghua　minguo,and　at　the　same　time　the　jurist　in　civil　law　also　reflects　on　the　old　idea　of　the　Dian.And　at　last　the　right　of　the　Dian　is　regulated　in　The　Code　of　Civil　Law.　The　chapter　4　summarizes　the　process　of　evolvement　from　the　Dian　to　the　right　of　the　Dian,and　sums　up　the　apocalypses　we　can　get　from　the　process.　The　conclusion　makes　a　summary　in　the　end.
