Legal Protection Of Private Property Rights

As to the steady progress of the reform and opening policy ,the private property of our country is growing fast, but the legal system concerning the protection of the private property right comparatively falls behind.In the legal field, the property right can be used in three different meanings:(l)the legal system of the property right;(2)the legal relationship of the property right;(3)the right of the property enjoyed by its possessors. The property right has different meanings from distinguishing perspective. The paper tries to begin the researching and discussion from the definition of the property right in the field of constitution, and attach importance to the legal protection of the defensive property right which is a basic human right.We have experienced a long-term process to understand the property and function of the private property right .Through the development of more than 20 years, we have made great progress in the legal protection of the private property right. But there are still some disadvantages existing, for example, the uncertainty of the property of private property right; the inadequate legal protecting system of the private property right; the negligence of the legal protection of the private property right.In order to research and discuss the reasons of the inadequate protecting legal system of our country's private property right, learn and analyze the foreign countries' legal protecting system of the private property right, the author suggests improving the private property right protecting system from the following aspects:(1)understanding and dealing with the protection of the private property right in the right attitude;(2)exactly positioning the legal protecting system of the private property right;(3)establishing and perfecting the constitutional protecting system of the private property right;(4)improving the related legal system;(5)enhancing the enforcement of law and the adjudication;(6)strengthening the legal publicity.
