The system of judicial expert appearing in court as a witness is the core of expert testing system. It is of great importance to the justice of judicial procedure and substantive judgment. In China, this system is not perfect up till the present moment. The dissertation makes a thorough approach to all aspects of judicial expert appearing in court as a witness, consisting of seven parts, about 34000 words.According to their internal relations, the seven parts can be summed up into three sections. The first section is devoted to the relations between procedural testimony and judicial expert testing, the definition and characteristics of judicial expert, the necessity of judicial expert appearing in court as a witness.The second section consists of the parts from Part 3 to Part 5. This section is the investigation and comparison on the systems of judicial expert appearing in court as a witness between the continental law system and the Anglo-American law system. The aim is to find out some beneficial enlightenment.The last section, consisting of Part 6 and Part 7, puts forward some legislative suggestions. This section is the main of this article. In China, the hard nut to crack is that the experts aren't willing to appear in court as a witness. On the basis of study of the causes and harms and according to the fact of our own country, some principles and systems are described by the dissertation, namely the system of judge attesting evidences in court, the systems of cross-examination, the system of legal responsibility of expert, the system of rights protecting to expert, the standard of expert testimony admissibility, the free proof principle, and so on.
