The system of positive prescription born of Low of the Twelve Tables in the age of Roman law , and most capitalism states used this system in legislation. Affected by the civil code of Soviet Union, our country, thinking it contrary to the socialist system all the time, negatives positive prescription, since the nineties, our country has pursued a system of the socialist market economy, setting up a perfect system of civil-mercantile-law becomes imperative under the circumstances so as to adapt the socialist market economy. After ,especially our legislative body suggested that the law of property ownership should be worked out, scholars are all dentical in the views of setting up the system of positive prescription. Now this essay, through analysing the system of positive prescription in other countries and the present situation in our country, such as the research and lessons in each other countries, the designs of its concrete system and the necessity of setting up it in our country, tries to carry on the legislation thought for positive prescription and hopes it can be of great benefit to setablishing this system in our country.
