Subrogation Litigation Res Judicata Research

Subrogation lawsuit, a new litigation approach, comes with the Perfection of the Contract Law of China. Studies in this field will not only promote the implementation of substantive law, but constitute a complement to and a development of the civil litigation theories of China. The first part of this article dwells on an introduction to the fundamental theories about the established verdict, and in the second part, while taking into account the basic concepts concerning subrogation lawsuit and the right of subrogation, the author attempts to address the following aspects regarding subrogation lawsuit such as its litigation standard, range of litigants, as well as the objective and subjective scopes of its established verdict, therefore drawing the conclusion that the established verdict of subrogation lawsuit should, based on the economic principles concerning litigation, break through the confinement of relativity for the sake of settling disputes and avoiding contradictive verdicts.
