Settling judicial cases by complaint letters and visit to executive branches rather than by judicial procedure still exists in our modern nomocracy . Such a phenomenon on one hand, harms our laws, on the other hand, is some kind of an inevitable result of the current circumstances. The cause, which leads up to the improper phenomenon, includes many factors, such as ideas, culture, system, working mechanism and so on. In my opinion, neither taking it for granted nor denying it absolutely is objective. In fact, we need analyze it impersonally, rationally and dialectically For the process of settling judicial cases by complaint letters and visit involves executive branch and judicial branch. So, the key to change it thoroughly is to straighten out relationship between the two branches. To my way of thinking, we could take three-step tactic as the following:Step1: Our first imperative is to process these cases as a batch.Step2: System construction is the vitally important basis for jurisdiction division between executive branch and judicial branch.
