Three conclusions are drawn in this essay through the research on American consumers class action, German consumers group action, Japanese consumers elected representative action and the systems in Taiwan, China. Those are the following: firstly, class action benefits the realization of social function, and it is cheap and convenient, but it is not adjusted to culture and social system in our nation; secondly, German group action is able to realize its social function in some way and it can be fit to our system; thirdly, Japanese elected representative action is not helpful tothe realization of social function of consumers rights litigation.Through the analysis on it, we can see the functional orientation of Chinese representative action to solve the mass dispute is not complete and cheap, and its rules are unclear. It is necessary to set up coalescent system of consumers rights litigation to settle the mass dispute and protect the rights of consumers in China, that is, to improve the alone action system, to reform the existing representative action system, to introduce German group action system.
