On Marital Property System In China

The couples' property rules are the legal rules to attach, manage, income, use and punish the couples' property, to discharge the couples' debt and the burden of family fees, to liquidate and divide the couples' property when the marriage ends and the property responsibility outside the family. It is an important property laws for most of couples. The marriage law of PRC was the first law in 1950, which was printed first after the new founding of China. During the fifties development, the change of the marriage law was little. Although it was changed, it is the change of property rules, which was presented by the change of couples' riles.On April 28, 2001, The Marriage Law, which was amended at the 21st meeting in the 9th NPC Standing Committee added new rules and stipulate three sections about couples' property definitely: Couples' Community Property, Couples' Promise Property, Couples' Single Property, consummating couples' property rules. Each law college and scholars talked about the couples' property rules in the amendment of marriage law, which caused a new upsurge to study marriage law.
