On The Control And Investigation Of Duty Crime Prevention Strategies In China

Official crime is not only a chronic disease that plagues all the countries but also the focus noticed by the mass especial the high-class leaders. It has both seriously harmed the nation and its people's benefit and the normal development of economy and distorted the Party and government's images in people's heart. Therefore, it has the most important practical significance to carry out and study the duty crime further for counter-corruption struggle. This paper has proposed preventive measures and the detecting strategy respectively on the base of examining its history and the present situation of our country, analyzing its traits and the cause it is formed.This article can be divided into three parts excluding the introduction and the ending part.The first part states the history and the present situation of duty crime in our country. First of all, it briefly generalizes the duty crime's characteristic in ancient times of our country by recalling the fundamental facts of early time such as the dynasties of Xia, Shang, Zhou, Warring states, Qin and Han, Tang, Song, Ming and Qing. Then it introduces the present situation of duty crime existing in our country. Finally, it analyzes both the trend of our nation's duty crime and the changes after our country's entering into WTO, which can be explained as follows: 1st, subject trends to be multiplication; 2nd, information of using resource, that is, the method and technique used by the crimes are more sophisticated with high-techniques; 3rd, type diversification and 4th, the method becomes more secret and isn't easy to be detected.The second part talks about the causes and the preventive measures to duty crime. Firstly, it states the basic cause of duty crime in our country by way of analyzing respectively from the theoryand the special situation of our country's transition as well as on the base it analyzes the harmful effect caused by duty crime. Secondly, it introduces the measures to preventing the duty crime taken by such international organizations as the United States, European Union and so on besides Hongkong Honest Government and their enlightenment on our country in anti-corruption struggle. Finally, it states our country's preventing counter-measures and the perfect presumption.The third part, also the key part, mainly elaborated the traits of duty crime and the detective strategy arising from the former, the whole course from the psycho-analysis to the detection of a case. In the end, it puts forward the relative judicial proposal to anti-duty crime in our country present and the future.
