The increasing rate of society problems induced by frequent medical malpractice is crucial, and we have to face the fact. Because of incomplete damage compensation systems for medical malpractice and lagging of related mechanisms, it is not within the limits of the distribution of profits and the commitment between doctors and patients, furthermore it leads to public trust crisis of medical. Therefore, reasonable designed systems would take important effects on relieving and resolving the problem step by step. The preface of the thesis tells the social harms caused by medical malpractice and legislation solutions of other countries. The first part compares the difference of conception on medical malpractice between China and other countries. The second part prescribes the models of professional-patient relationship and the theory of Informed Consent. The third part discusses superposition of civil responsibility, subjective body and object of damage compensation, counting standards and principles of responsibilities' belongings. The fourth part suggests developing and perfecting the systems of damage compensation for medical malpractice in the views of legislation and insurance.
