On The Course Of Justice

As final object that mankind has been pursued, judicial justice is firstlyproposed and successfully operated by the westerners. Fundamentally, Chinadidn't have the environment which produced and developed idea ofgovernment by law because of feudal autocratic tradition. With modern society and economy's reform, the society structure and regulation mode of China has become useless. It becomes important to rebuild society regulation mode. With the idea of rights' enhancement, judicial is gradully become concerned by people. It is worth congratulating for the importance of judicial to be concerned, but the reality condition is worrying. The bad condition caused by thousands of feudal tradition idea makes people hesitate because the perfect feeling in westerners doesn't exist in China. In the opposite, they are full of demonstrate strong discontent and want to give up, even frightened. Hope with disappointed to coexist, crave for with frightened to coexist, we need settling the contradiction. So I want to pursue the real cause. I start with analyzing purpose of judicial justice, and then analyze the composition key element of the judicial justice, at the same time, basing on tradition's analysis, namely whether in ruling by law on the initial stage not starting, the judicial justice is of value to people and be approved by people for governed by law. In the oppostite, inequitable justice may affect people feeling for justice and may unaccept even betray to kill it in the cradle. Judicial justice promotes government by law, but inequitable justice destroys government by law. So the meaning of judicial justice becomes more important.Seek the inequity of the realistic administration of justice. I have been seeking it not only on the dominant aspect, but also, more importantly, from the inner reason. On the dominant aspect, inequity justice means independent justice. I have explain rhe reason from judicial corruption and in the way of mankind and society. Justice system's unreasonablity, court system's weakness, judge selecting system's unstandard are all the back of these phenomena.At last, I try to design a document which is useful to judicial justice from important aspect. At first, dependant justice system should be set up and be assuredfrom outer and inner system operation. Then, judicial procedure should be built to make judicial justice to become realization.And then, the most important link, judge quality's training and selecting system should be set up according to the western style. At last, to justice supervision, news media's supervision should be concerned to prevent justice corruption. At the same time, basic on judicial indepence, news media's supervision range should be defined. To accomplish judicial justice, We should perfect the above system and set up a reasonable justice system.
