The crime of misappropriating public funds was first regulated in 《 Supplementary provisions concerning the punishment of the crimes of embezzlement and bribery》 by the Standing Committee of the National People's Congress . The Criminal law of the People's Republic of China (1997) in Article 384 concisely put it : "any state functionary who , by taking advantage of his position , misappropriates public funds for his own use or for conducting illegal activities , or misappropriates a relatively large amount of public funds for profit -making activities or misappropriates a relatively large amount of public funds and fails to return it after the lapse of three months , shall be guilty of misappropriation of public funds......"This essay with 32000 words consists of three parts including preface ,main part ,conclusion . the main body is divided into four parts.The preface briefly introduces : the legislation practice and concept of the crime of misappropriating public funds, some related arguments during the past few years,the importance of theory study.The first part focuses on the question of misappropriating public funds for his own use and differentiates between "public funds "and "public property". The second part pays attention to the question of what is and how to understand "misappropriation" in misappropriating public funds for his own use. The third part concentrates on the question of what is and how to understand "oneself" in misappropriating public funds for his own use. The fourth part analyzes some questions about how and by which way to use the misappropriated public funds inmisappropriating public funds for his own.Finally, the essay makes the necessary conclusion about the main questions, and also gives some advices about perfecting in legislation of the crime of misappropriating public funds.
