The paper tries to analyze the bidden of proof in compensation accusation of medical injure in the economic way.The paper is made up of three parts. Part one mainly talks about how different distribution systems of the burden of proof influencing costs of accusation, prevention of tort and usage of sanitary resource. Part two analyzes different distribution systems and evolutions of them in economic theory of the burden of proof in compensation accusation of medical injure. In Part three the author gives suggestions to how to construct reasonable distribution system of the burden of proof in compensation accusation of medical injure.
