Government Structural Reform, Discretion Is The Application Of Research

On the basis of past research this article particularly researches the problem how to use administrative right of discretion in administrative organ mainly through scientific and practical research methods.The basic proposition of this article is that the administrative right of discretion is not controlled right and the administrative right of discretion must be restricted by various factors from every fields of society. The administrative right of discretion is the main approach for government to realize the functions of government, but the deviation from object of government behaviors in the course of execution often occurs when the government uses its functions with the right of discretion. The change of functions of government is the core content of political system reformation of our country and the key factor of change of functions of government is the correct using of right of discretion of administrative organ. The article analyzes how to use administrative right of discretion in the course of realizing functions of government.The first chapter mainly introduces the conception of administrative right of discretion and its regulations on law in our country and the understanding of right of discretion in our country.The second chapter mainly introduces the relation between functions of government and administrative right of discretion in democratic countries, i.e., the function of government of a country is the definitive factor for applying right of discretion and the application of right of discretion must accord with the object of realization of functions of government.The third chapter firstly introduces the target of system reformation of government of our country and the functions of government, which the governments of our country should have, and secondly explains the problems of inappropriation of using of right of discretion in the course of realizing of functions of government.The last chapter expounds the application of discretion of administrative organ under special situation of our country and the main supervision methods for administrative right of discretion.
