This article pay main attention to analyze the advancement and the shortcomings about the spouses property institution in the present marriage law on the basis of the studying of the same institution in the foreign law and the reviewing of the relative institution in our legislation history, then the author puts forward some legislation suggests.In the first part, the author discusses the definition and the quality of the spouses property institution, and analyses the basic principle of the legislation. Then points out the regulations of the law should be the object of the research of the spouses property institution on the basis of the legislation forms of the spouses property institution in our law was looked over.In the second part, the author reviews the relative institution in the foreign law and compares them and ours,then some useful conclusions to the study of our spouses property institution is drawn out.In the third part, after looked back the development history of our spouses property institution, new legislation principle about this institution is advocated according to the deeply change in our country's economic and society areas. Then through comparing to the 1980'relative institution, the shortage of the present spouses property institution is indicated.At last, all-round suggests about the legislation of the spouses property institution are brought forward in seven aspects.
