Lease, both a conduct of economy and of law, has a long history. As for this paper, emphasis is paid on lease's characteristic of legal conduct. No matter what kind of forms lease present, there is something in common that lease separates the ownership and right of use. As a common but important social relation in social economic life, lease is of great impact in legal regulations, and the legal system concerning lease plays a key role in a country's legal institution which develops along with social development and furnishes via social practices. The legal system of lease is full of vitality and with a prosperous future and that is the aim and importance of this paper.This paper includes three parts:The first part has three chapters. The former two chapters give general description of lease contract and lease, including the conception and trait of lease, the concept and characteristic of lease contract, concept and nature of right of lease. Based on the above-mentioned content, the vital chapter is introduced: emerge and connotation of trend of lease's turning into real right and some legislative enlightenment for our country.Based on part one, the second part focuses on house lease. In view of our country's special condition, the first chapter of this part introduces concept and trait of public housing lease, and discusses some problems and difficulties concerning public housing lease. The second chapter introduces the priority of lessee of house lease, including discusses on applications of priority in our country, notion and applying condition of lessee's priority, problems concerning that priority in practice and judicial precedent, and gives writer's own advices and solution.
