This thesis demonstrated the legislation on the crime of fraud in contract in China and the world in order to mark the practical significance. In research of the definition overall, the writer definite the crime of fraud in contract, namely it is action which destroyed the marked. By the means of fabrication on withholding the truth in signing or performing a contract in order to gain the procession by cheating. Then the writer made a systematic exposition on the construction of the crime subjectively and objectively. Moreover, the writer distinguished the crime, deceit and disputes of contract on the motive, ability, activity and consequence. Though activities are almost the same between the crime and the deceit, the difference existed between the direct intention and the indirect intention, also the procession illegally. In the end, the writer researched definitions of the crime. Including the crime in order to process illegally, one crime and many kinds of crimes; successively deceit commits many kinds of crimes and follow ship in crime, so that we can affirm the crime of fraud in contract in practice.
