At the moment, the conflicts that between the action of immovable property's expropriation and the property in goods are becoming increasingly obvious, and the new social conflicts are initiated. In order to settle the problem, we must study the drawback of law system of immovable property's expropriation, comparing with and drawing lessons from the theories and judicial practices of law system's design in west developed countries, recognizing the law character of expropriate conduct of immovable property correctly. Then by means of the perfecting the related legislation such as the real law, we should limit the purpose and the subject of immovable property's expropriation strictly, improve the expropriate procedure, the standard of compensation for damage and the remedial ways. We should strengthen the law system of the protection for private rights under the market—oriented economy, uphold the social's stability and promote the overall development of our economy and society.
