Compulsory Administrative Measures Study

The Administrative Enforcement Measure, which has great practical significance for the guarantee of enforcement of law, regulations and administrative power, is the essential means of the administrative management in a country. It is meaningful to maintain public order and safeguard the interests of citizens. Since the Administrative Enforcement Measure is characterized by enforcement, its establishment and enforcement are of the vital importance to the basic interests of the subject of right. A standardized and restricted Administrative Enforcement Measure is always one of the important problems which administrative law studies a lot. This thesis explores the basic theoretical questions of it, compares it and foreign immediate enforcement, proposes to improve the system and the establishment of legislation which is based on the analysis of the legislation and practice of the Administrative Enforcement Measure.The present thesis is divided into four parts. Chapter One defines the Administrative Enforcement Measure which is classified according to different standards, and shows the seven characters of law. Also, this chapter talks about the difference between the Measure and other concepts and explores the basic principle of the Measure. Chapter Two analyzes the immediate enforcement in other countries such as Germany, Japan, the UK, the US and France which is similar to the Administrative Enforcement Measure in China. It would be helpful for China to establish the Measure. Chapter Three introduces the present mode of the Administrative Enforcement Measure and some contentious measures and points to the main problems of the present mode in China. Chapter Four which is based on the analysis mentioned above explores some aspects such as the basic mode, the establishment of Power, basic principle, methods, the installation of procedure and the succor of rights as well as includes the proposal to improve the mode of the Administrative Enforcement Measure in China.
