On The Improvement Of The International Investment Liberalization In The Context Of China's Foreign Investment Legislation

After 1980's, there are some practices in international investment liberalization in bilateral,regional, and multilateral dimension. The thesis summarizes the effects being had byinternational investment liberalization on China from aspects of consumer & employee,industry and development of Chinese economy and analyzes the status and defects of Chineseforeign investment legislature. Finally it focuses on the defects above mentioned, studiesseveral topics in foreign investment legislature, and points out the attitude or principle on theseissues.Developing countries have no enough passion to push the progress of investmentliberalization such as opening service industry market or totally national treatment becausemost of them are capital import country. We can't agree the argument issued by developedcountries especially the United States that the application scope of national treatment willexpand from "post-establishment" to "pre-establishment". Our country still restrict some keyfields related to state security, public interests, and national plan & people's life such as specialnatural resources, traditional national industry, na?ve trade, pillar industry etc in order to assureforeign investment to conform to purpose and general requirement of Chinese economydevelopment. The reduction and elimination of investment measures is current trend. Chinashould treat and adapt to this trend calmly and find the corresponding counter measures. Weshould try our best to avoid promising to eliminate investment measures, while in domesticreform we should reduce investment measures gradually and create an equal investingenvironment for domestic enterprise and foreign investment.The author advocates that it isnot the right opportunity to uniform foreign investment law and regulations to domesticenterprise one such as Company Law, Partnership Law etc.
